Terms of sale for digital audio guides

Effective from 12 October 2026

These terms govern the purchase and use of audio guides (digital content) on tripto.de. Please read them before ordering — accepting them is required to buy. The tripto.de terms of use apply otherwise.

1. Seller

Your contractual partner and seller is Bartosz Kołodziej, Łubowo 127, 62-260 Łubowo, Polen, e-mail kontakt@tripto.de (“we”, the “Seller”). Contact for orders and complaints: kontakt@tripto.de.

Payment and VAT are handled through Stripe Managed Payments: the merchant of record for the payment is Sold through Link, LLC, a Stripe group company (“Link”). The “Sold Through Link Terms” (https://link.com/terms#sold-through-link-terms) also apply to the payment. We remain responsible for the content, supply and conformity of the digital content.

2. Scope and definitions

These terms apply to purchases of audio guides (digital content) on tripto.de. A consumer is any natural person who concludes a transaction for purposes that are predominantly outside their trade, business or profession. Conflicting terms of the buyer do not apply.

Audio guide — digital content for one walking route: narration recordings for the stops, their transcripts, directions, photos and the route map, made available in the Player. Player — the tripto.de web app running in the browser (addresses starting with tripto.pl/audio/). Device — a browser on a phone, tablet or computer on which access has been activated. Access code and activation link — data sent to the Buyer by e-mail for activating access.

3. Subject of the contract

The Seller supplies digital content not supplied on a tangible medium: access to the chosen Audio guide in the Player, in the language versions available for that route, for the period set out in section 8 and on the number of Devices set out in section 7.

The narration is read by a synthetic (AI) voice; the script and facts are prepared by the tripto.de editorial team. Route information (number of stops, length, approximate time, languages) is shown on the Audio guide page before purchase. Free previews (e.g. the introduction and the first stop) can be played without buying.

The Audio guide is informative and does not replace care as a pedestrian. Opening hours and visiting rules may change — please check them with the venues. Admission tickets are not included in the price.

4. Technical requirements and offline mode

You need a Device with an up-to-date mainstream browser (e.g. Safari, Chrome, Firefox, Edge) with JavaScript, essential cookies (the Device licence is stored in a cookie) and the browser’s local storage enabled. We recommend headphones and a charged phone. No app installation or account is required.

An internet connection is needed to activate access, to play recordings that have not been downloaded and to display the map. In the Player menu you can download the route for offline use (“Download for offline”): the recordings in the chosen language, stop texts and photos are saved in the browser storage on that Device and work without internet; the map needs a connection. The download size is shown beforehand — the Device needs enough free space.

Downloaded files can be removed at any time (“Remove download”). The browser or the user may also remove them when clearing browser data or when storage runs low — simply download the route again. Downloaded files only work in the Player and are removed when the access period ends.

Walk mode uses the Device location (GPS) with the user’s permission, only in the browser — the position is not sent to the Seller. Without location permission you choose the stops manually.

5. Prices and payment

All prices are final prices in euros including statutory VAT. There are no delivery costs. Prices may be reduced with a promotion code on the payment page.

Payment is handled by Link (Stripe). The payment methods shown on the payment page are available (e.g. credit or debit card, Apple Pay, Google Pay, Link). Payment is due when you order. Your bank statement shows the charge with the reference “LINK.COM*”.

Link calculates and remits VAT and automatically e-mails you a receipt or invoice (PDF) after payment. Businesses can enter their VAT ID on the payment page.

6. Conclusion of the contract and supply

The presentation on the audio guide page is not a binding offer. You make a binding offer by entering your e-mail address, accepting these terms, making the statement on the right of withdrawal and clicking “Buy now”; you are then taken to the payment page. The contract is concluded when payment is successfully completed. Until then you can correct your entries or cancel at any time; unpaid orders expire after 60 minutes.

The contract language is German (this English version is for information). We do not store the contract text separately; you receive a confirmation with the order details by e-mail, and these terms are available on this page at any time and can be saved or printed.

After payment, access is provided immediately: the page after payment activates the audio guide on the device used for the purchase, and we send an activation link and access code by e-mail. This e-mail also confirms the contract on a durable medium, including your statement on the right of withdrawal.

7. Activation, device limit and invitations

Access is activated on a Device with the link from the e-mail, by entering the Access code at tripto.pl/audio/aktywuj/ or through a companion invitation. One purchase covers up to 4 Devices. Re-activating in the same browser on the same Device does not use a new slot; after clearing browser data or switching browsers the Device may count as new.

A person with active access can create a companion invitation (QR code or link) in the Player menu. The invitation is valid for 24 hours, and activating through it uses a slot in the Device limit of the same purchase.

Once the limit is reached, no further Device can be activated. On request to kontakt@tripto.de (from the purchase e-mail address or with the Access code) we will disconnect an unused Device to free a slot.

8. Access period

Access lasts 365 days (12 months) from the first activation on any Device — not from the purchase date. The same end date applies to all Devices activated under the purchase. Afterwards, the Player no longer plays the full route (free previews remain available) and files downloaded for offline use are removed.

Access ends earlier if the contract is terminated — in particular after a refund (withdrawal or an upheld complaint) or in the case described in section 9.

9. Licence and no sharing

The Buyer receives a non-exclusive, non-transferable licence for personal, non-commercial use of the Audio guide in the Player, during the access period and on the number of Devices set out in section 7 — including together with companions invited within the limit.

In particular, it is prohibited to share the Access code, activation link or invitations to use the Audio guide beyond the Device limit, including publishing, selling or exchanging them; to copy, record or distribute recordings and transcripts outside the Player; to play the guide publicly (e.g. to organised groups) or use it commercially without a separate agreement; and to circumvent safeguards or download files automatically.

In case of a breach, the Seller may disconnect Devices activated in breach of the limit and, for a serious or persistent breach and after an unsuccessful request to stop, terminate the contract with immediate effect. We inform you of the decision by e-mail with a statement of reasons.

10. Right of withdrawal

Right of withdrawal: you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise it, you must inform us (Bartosz Kołodziej, Łubowo 127, 62-260 Łubowo, Polen, kontakt@tripto.de) by means of a clear statement (e.g. an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the deadline, it is sufficient to send your notice before the withdrawal period has expired.

Effects of withdrawal: if you withdraw, we will reimburse all payments received from you without undue delay and at the latest within 14 days of the day on which we receive your notice, using the same means of payment you used for the original transaction; you will not incur any fees as a result.

Refunds are paid out through Link (Stripe) to the original means of payment. You can also request a withdrawal or refund directly from Link support (https://support.link.com/topics/sold-through-link); any further rights granted to you under the Link terms remain unaffected.

Early expiry: the right of withdrawal expires once access is activated after payment, provided that you (1) expressly requested immediate access before the end of the withdrawal period, (2) acknowledged that you thereby lose your right of withdrawal, and (3) we have sent you a confirmation of the contract (Section 356(5) BGB; Art. 16(m) Directive 2011/83/EU). You give this consent in a separate checkbox when ordering. If access has not yet been provided, you may still withdraw.

Model withdrawal form — complete and return this form only if you wish to withdraw from the contract:

To: Bartosz Kołodziej, Łubowo 127, 62-260 Łubowo, Polen, kontakt@tripto.de. I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the supply of the following digital content (*)/service (*): … Ordered on (*)/received on (*): … Name of consumer(s): … Address of consumer(s): … Signature of consumer(s) (only if this form is notified on paper): … Date: … (*) Delete as appropriate.

11. Warranty, complaints and liability

The statutory warranty rights for digital products apply. We must supply the digital content free of defects. If there is a defect, we will first restore conformity (e.g. regenerate the file or restore access); otherwise you may reduce the price or end the contract in accordance with the law.

Please send complaints to kontakt@tripto.de with your order number or the e-mail address used for the purchase and a short description. We reply within 14 days.

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage. Statutory consumer rights remain unaffected.

12. Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. For cross-border disputes, the European Consumer Centre network (ECC-Net) offers free assistance.

13. Personal data

The Seller is the data controller. We process your e-mail address and order data to perform the contract (Art. 6(1)(b) GDPR) and invoicing data to meet tax obligations (Art. 6(1)(c) GDPR). Payment and billing data are processed by Link and Stripe as independent controllers. Details: tripto.de privacy policy.

14. Final provisions

The version of these terms in force when you order applies. The law of the Seller’s place of business applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers, this choice of law does not deprive them of the protection of mandatory provisions of the country of their habitual residence (in particular German consumer law). If a provision is invalid, the rest of the contract remains in force.
